Natural Jewels and Fabric Dreams Online Shop – General Terms and Conditions (GTC) with consumer information

§ 1 Scope and contractual partners

1. 1. These General Terms and Conditions (GTC) apply to all contracts concluded between you as the customer and me as the operator of the Naturjuwelen and Stoffträume online shop in Austria. During the ordering process, you acknowledge the GTC in the version valid at the time you place your order.

§ 2 Conclusion of contract

1. My product presentation in the online shop does not constitute a binding offer to sell. The offer to conclude a purchase contract is made by you, the customer, by clicking the „Submit order“ button after completing the order page or placing an order by phone. You remain bound to this order for one week, i.e., the contract is binding if I accept your order within this period.
2. After placing your order, you will receive an automated email confirming receipt of your order. This does not constitute acceptance of the contract (order confirmation). I will confirm acceptance of the contract by a separate email as soon as the goods leave my warehouse (shipping confirmation) or, at the latest, upon delivery of the goods. This also applies if, using the payment method you selected, you have already paid the purchase price or authorized payment before the contract is concluded. If, in exceptional cases, I cannot accept your order due to a lack of availability of the goods or if the contract is not concluded for other reasons, I will, of course, refund the advance payment immediately.
3. If your order includes multiple items, the contract will only be concluded for those items expressly listed in my shipping confirmation.
4. Your statutory right of withdrawal (see Section 6) remains unaffected by the above provisions in any case.
5. For security reasons, each order is limited to a maximum order value of 500 euros.
6. The contract is concluded in German. The contract text is not stored on my internal systems.

§ 3 Prices and shipping costs

1. The prices listed in my online shop are in euros.
2. I ship to addresses within Austria for a flat shipping fee of €6.50, to Germany and Switzerland for a flat shipping fee of €11.50, and to the rest of the EU for a flat shipping fee of €19. Shipping to other countries and the associated delivery costs are available upon request.
3. Shipping is free within Austria for orders over €100, and free to Germany and Switzerland for orders over €150.
4. You are also welcome to pick up the goods on site.

§ 4 Payment and retention of title

1. Payment of the purchase price can be made either by advance bank transfer (prepayment) or by on-site pickup and cash payment. For advance bank transfers, I will inform you of the invoice amount and my bank details in the order confirmation. The invoice amount is due immediately. The conclusion of the contract remains subject to § 2, paragraph 2.
2. I retain title to the delivered goods until full payment of the respective invoice amount for a delivery (final and unconditional credit of the total purchase price including any additional costs).

§ 5 Delivery times

1. Unless I specify a delivery time or otherwise agree, it will normally be 3 to 5 working days.

§ 6 Right of withdrawal

According to the regulations on distance selling, I must inform you of your right of withdrawal:

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period shall be fourteen days from the day on which you or a third party other than the carrier designated by you takes possession of the goods. To exercise your right of withdrawal, you must notify me, Alexandra Scherer, Janischhofweg 61, A-8043 Graz, email: alexandra.scherer@naturjuwelenundstofftraeume.at, phone: +43 676 3200369, of your decision to withdraw from this contract by means of an unambiguous declaration (eg a letter sent by post or email). You may use the attached model withdrawal form for this purpose, but this is not mandatory. To meet the withdrawal deadline, it is sufficient that you send your notification of exercising your right of withdrawal before the expiry of the withdrawal period.

Consequences of revocation

If you cancel this contract, I will refund all payments that I have received from you, including delivery costs, promptly and at the latest within fourteen days from the date on which I received notification of your cancellation of this contract. For the refund, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; Under no circumstances will you be charged any fees for this refund. I may refuse to refund until I have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier. You must return or hand over the goods to Alexandra Scherer, Janischhofweg 61, A-8043 Graz promptly and in any event no later than fourteen days from the date on which you notified me of the cancellation of this contract. This deadline is met if you send the goods before the expiry of the fourteen-day period. You will bear the direct cost of returning the goods. You only have to pay for any loss of value of the goods if this loss of value is due to handling of the goods which is not necessary to check their quality, properties and functioning.

§ 7 Customer rights in the event of defects

1. Your rights in the event of material and legal defects are governed by statutory provisions. However, I assume no liability for descriptions provided by third parties, particularly by customers in the context of customer reviews published in my online shop.
2. Your statutory right of withdrawal (see Section 6) and rights arising from any warranty declarations issued separately or enclosed with the goods remain unaffected in all cases.

§ 8 Choice of law and place of jurisdiction

The contractual relationship shall be governed exclusively by Austrian law, excluding any substantive uniform law, in particular the UN Convention on Contracts for the International Sale of Goods. The statutory provisions shall apply to the place of jurisdiction.

§ 9 Severability Clause

Should one or more provisions of these General Terms and Conditions be or become invalid or inadmissible in whole or in part, this shall not invalidate the entire contract. The invalid or inadmissible provision shall be replaced by a provision that most closely approximates the economic purpose of the invalid or inadmissible provision.

§ 10 Vouchers

Redemption of promotional vouchers Promotional vouchers (value vouchers that cannot be purchased but that I issue as part of an advertising campaign with a specific period of validity) are only valid for the specified online shop, only during the specified period, and can only be redeemed once during an order process. To be redeemed, the value of the goods must be at least equal to the amount stated on the promotional voucher. Combining them with other vouchers or additional promotional vouchers is not possible, and cash payments or refunds are excluded unless something has been paid in return. Transfer to third parties and publications are prohibited. If you use a promotional voucher for your purchase, I reserve the right to charge you the original price of the goods you keep if – due to your cancellation – the total value of the order falls below the respective value of the promotional voucher.
